PAIA Manual

This manual explains which records Legalyze holds, which records are available without a formal request and how to request access under PAIA.

1. Introduction

This manual is prepared in terms of section 51 of the Promotion of Access to Information Act 2 of 2000, as amended (PAIA). Its purpose is to help members of the public identify records held by Legalyze (Pty) Ltd and understand the procedure for requesting access.

3. Head and Information Officer

PAIA requests and POPIA enquiries may be directed to the Information Officer at info@legalyze.co.za. Use the subject line PAIA Request for an access-to-records request.

4. PAIA guide and prescribed forms

The Information Regulator publishes a guide explaining how to use PAIA, together with the prescribed forms. A request for access to a record must be made on Form 2: Request for Access to Record. The guide and forms are available from the Information Regulator’s website and eServices portal.

5. Records available without a formal PAIA request

The following records are generally available on the website or on ordinary request, subject to privacy, confidentiality and intellectual-property restrictions:

  • service descriptions and published pricing;
  • website terms, privacy information, cookie information and this PAIA Manual;
  • public educational guides and articles;
  • company particulars that are publicly available from CIPC;
  • marketing material and public contact information; and
  • records supplied by a customer to that same customer, after identity verification where required.

6. Categories of records held

Corporate and governance records

  • incorporation and CIPC records;
  • company policies, resolutions and internal registers;
  • licences, registrations and compliance records.

Customer and service records

  • enquiries, assessments, instructions and correspondence;
  • identity, immigration, company and compliance documents supplied for a service;
  • checklists, drafts, submissions, status records and final deliverables;
  • portal activity, support messages and document-request history.

Financial and commercial records

  • quotes, invoices, payment references and accounting records;
  • supplier and service-provider agreements;
  • tax and statutory records.

Personnel and contractor records

  • employment or contractor agreements;
  • payroll, leave, performance and training records, where applicable;
  • identity, qualification and compliance records.

Technology, security and marketing records

  • website and system logs;
  • security, backup and incident records;
  • analytics, campaign and CRM records where enabled with the required consent;
  • intellectual-property and content records.

7. Records held under legislation

Legalyze may hold records under legislation including PAIA, POPIA, the Companies Act, tax legislation, labour legislation, consumer-protection legislation, electronic-communications legislation and other laws applicable to a particular service or business activity.

8. How to request access

  1. Complete the prescribed PAIA Form 2.
  2. Describe the record clearly enough for it to be identified.
  3. Explain the right you seek to exercise or protect and why the record is required for that purpose, where PAIA requires this.
  4. State the preferred form of access and provide contact details.
  5. Email the signed form and supporting proof of identity or authority to info@legalyze.co.za.

Legalyze may request further information, proof of identity or proof that a representative is authorised to act. Prescribed request and access fees may apply. A decision is ordinarily communicated within the period prescribed by PAIA, subject to any lawful extension.

9. Grounds on which access may be refused

Access may be refused or limited on grounds permitted or required by PAIA, including protection of personal information, confidential commercial information, third-party records, privileged material, safety and security, research information, intellectual property and records whose disclosure is prohibited by law. Where possible, access may be granted to a severable part of a record.

10. Remedies

A requester who is dissatisfied with a decision or a failure to respond may use the remedies available under PAIA. A complaint to the Information Regulator is made on the prescribed Form 5 and is subject to applicable requirements and time limits.

11. Availability and updates

This manual is available on the Legalyze website and may be requested from the Information Officer without charge. It will be reviewed when the company’s records, contact details or legal obligations materially change. Accessible or alternative-language assistance may be requested from the Information Officer.
